Definitions

Client: any professional or individual capable in the sense of articles 1123 and following of the Civil Code, or legal entity, who visits the Site subject to these general conditions.

Services and Services: Consors Intelligence provides Clients

Content: All elements constituting the information present on the Site, including texts – images – videos. Client information: Hereinafter referred to as “Information(s)” which corresponds to all personal data that may be held by Consors Intelligence for the management of your account, the management of the client relationship and for analysis and statistical purposes.

User: Internet user connecting, using the aforementioned site. Personal information: “Information that enables, in any form, directly or indirectly, the identification of the individuals to whom it applies” (article 4 of Law No. 78-17 of January 6, 1978).

The terms “personal data”, “data subject”, “processor” and “sensitive data” have the meaning defined by the General Data Protection Regulation (GDPR: No. 2016-679)

Terms and conditions of use of the site and the services offered

The Site constitutes a work of the mind protected by the provisions of the Intellectual Property Code and applicable International Regulations. The Client may not in any way reuse, assign or exploit for their own benefit all or part of the elements or works of the Site. The use of the Consors Intelligence website implies full and unconditional acceptance of the general terms of use described below. These terms of use are subject to modification or enhancement at any time, and users of the Consors Intelligence site are therefore invited to consult them regularly. This website is normally accessible to users at any time. A disruption for technical maintenance may however be decided by Consors Intelligence, which will strive to communicate in advance to users the dates and times of the intervention. The Consors Intelligence website is regularly updated by the responsible Consors Intelligence. Similarly, the legal notices may be modified at any time: they are nevertheless binding on the user, who is invited to refer to them as often as possible in order to be informed.

Description of the services provided

The Consors Intelligence website aims to provide information about all the activities of the company. Consors Intelligence strives to provide information on the Consors Intelligence site that is as accurate as possible. However, it cannot be held responsible for omissions, inaccuracies, or deficiencies in updating, whether due to its own actions or those of third-party partners providing this information. All information provided on the Consors Intelligence site is for informational purposes only and is subject to change. Furthermore, the information contained on the Consors Intelligence site is not exhaustive. It is provided subject to modifications that may have been made since it was published.

Contractual limitations on technical data

The website cannot be held responsible for material damages related to the use of the site. Moreover, the user of the site agrees to access the site using up-to-date equipment that is virus-free and with a modern, updated browser. The Consors Intelligence site is hosted by a provider within the European Union in accordance with the provisions of the General Data Protection Regulation (GDPR: No. 2016-679). The aim is to provide a service that ensures the best accessibility rate. The host guarantees the continuity of its service 24 hours a day, every day of the year. However, it reserves the right to interrupt the hosting service for the shortest possible durations, particularly for maintenance, infrastructure improvements, infrastructure failures, or if the Services and Benefits generate traffic deemed abnormal. Consors Intelligence and the host cannot be held responsible in the event of a malfunction of the Internet network, telephone lines, or computer and telephony equipment, particularly related to network congestion preventing access to the server.

Intellectual property and infringements

Consors Intelligence owns the intellectual property rights and holds the usage rights to all the elements accessible on the website, including texts, images, graphics, logos, videos, icons, and sounds. Any reproduction, representation, modification, publication, or adaptation of all or part of the elements of the site, regardless of the means or process used, is prohibited without prior written authorization from: Consors Intelligence. Any unauthorized exploitation of the site or any of the elements it contains will be considered as constituting an infringement and will be prosecuted in accordance with the provisions of Articles L.335-2 and following of the Intellectual Property Code.

Limitations of liability

Consors Intelligence acts as the publisher of the site. Consors Intelligence is responsible for the quality and accuracy of the Content it publishes. Consors Intelligence cannot be held responsible for any direct or indirect damages caused to the user’s material when accessing the Consors Intelligence website, resulting either from the use of equipment that does not meet the specifications indicated in point 4, or from the occurrence of a bug or incompatibility. Consors Intelligence also cannot be held liable for indirect damages (such as, for example, loss of market or lost opportunity) resulting from the use of the Consors Intelligence site. Interactive spaces (the possibility to ask questions in the contact area) are available to users. Consors Intelligence reserves the right to remove, without prior notice, any content posted in this space that contravenes applicable legislation in France, particularly the provisions relating to data protection. If necessary, Consors Intelligence also reserves the right to impose civil and/or criminal liability on the user, particularly in the case of messages of a racist, abusive, defamatory, or pornographic nature, regardless of the medium used (text, photographs, etc.).

Personal data management

The Client is informed of the regulations concerning marketing communication, the law of 21 June 2014 for trust in the Digital Economy, the Data Protection Act of 6 August 2004, as well as the General Data Protection Regulation (GDPR: no. 2016-679).

Responsible for the collection of personal data

For the Personal Data collected as part of the creation of the User's personal account and their navigation on the Site, the data controller is: Consors Intelligence. Consors Intelligence is represented by Bertrand CHARLES, its legal representative. As the data controller of the data it collects, Consors Intelligence is committed to complying with the framework of the legal provisions in force. It is the Client's responsibility, in particular, to establish the purposes of its data processing, to provide its prospects and clients, based on the collection of their consents, with complete information about the processing of their personal data, and to maintain a processing register that is compliant with the reality. Whenever Consors Intelligence processes Personal Data, Consors Intelligence takes all reasonable measures to ensure the accuracy and relevance of the Personal Data concerning the purposes for which Consors Intelligence processes them.

Purpose of the data collected

Consors Intelligence may process all or part of the data to enable navigation on the Site and the management and traceability of the services and products ordered by the user: connection and usage data of the Site, billing, order history, etc. to prevent and combat cyber fraud (spamming, hacking...): computer hardware used for navigation, IP address, password (hashed) to improve navigation on the Site: connection and usage data to conduct optional satisfaction surveys on Consors Intelligence: email address to carry out communication campaigns (SMS, email): phone number, email address. Consors Intelligence does not sell your personal data, which are only used when necessary or for statistical and analytical purposes.

Rights of access, rectification and opposition

In accordance with current European regulations, Users of Consors Intelligence have the following rights: right of access (Article 15 GDPR) and rectification (Article 16 GDPR), to update and complete Users' data; right to restrict or delete Users' personal data (Article 17 GDPR) when they are inaccurate, incomplete, ambiguous, outdated, or when their collection, use, communication, or retention is prohibited; right to withdraw consent at any time (Article 13-2c GDPR); right to limit the processing of Users' data (Article 18 GDPR); right to object to the processing of Users' data (Article 21 GDPR); right to data portability for the data Users provide when this data is subject to automated processing based on their consent or a contract (Article 20 GDPR); right to determine the fate of Users' data after their death and to choose to whom Consors Intelligence should communicate (or not) their data to a third party they have previously designated. As soon as Consors Intelligence becomes aware of a User's death and in the absence of instructions from them, Consors Intelligence agrees to destroy their data, unless its retention is necessary for evidential purposes or to comply with a legal obligation. If the User wishes to know how Consors Intelligence uses their Personal Data, requests rectification, or opposes their processing, the User can contact Consors Intelligence in writing at the following address: contact@consors-intelligence.com. In this case, the User must specify the Personal Data they would like Consors Intelligence to correct, update, or delete, identifying themselves precisely with a copy of an identification document (identity card or passport). Requests for deletion of Personal Data will be subject to the obligations imposed on Consors Intelligence by law, notably regarding the retention or archiving of documents. Finally, Users of Consors Intelligence may file a complaint with the control authorities, including the CNIL (https://www.cnil.fr/fr/plaintes).

Non-communication of personal data

Consors Intelligence prohibits the processing, hosting, or transferring of information collected on its clients to a country outside the European Union or one recognized as "not adequate" by the European Commission without prior notification to the client. However, Consors Intelligence retains the freedom to choose its technical and commercial subcontractors provided they offer sufficient guarantees regarding the requirements of the General Data Protection Regulation (GDPR: No. 2016-679). Consors Intelligence commits to taking all necessary precautions to ensure the security of the information, particularly that it is not communicated to unauthorized individuals. However, if an incident affecting the integrity or confidentiality of the client's information comes to the attention of Consors Intelligence, the latter must inform the client as soon as possible and communicate the corrective measures taken. Furthermore, Consors Intelligence does not collect any "sensitive data." The personal data of the user may be processed by subsidiaries of Consors Intelligence and subcontractors (service providers), solely for the purposes of this policy. Within the limits of their respective assignments and for the purposes detailed above, the main individuals who may have access to the data of Consors Intelligence's users are primarily our customer service agents.

Incident Notification

Regardless of the efforts made, no method of transmission over the Internet and no method of electronic storage is completely secure. Therefore, we cannot guarantee absolute security. If we become aware of a security breach, we will notify the affected users so they can take appropriate measures. Our incident notification procedures take into account our legal obligations, whether at the national or European level. We are committed to fully informing our clients about all issues related to the security of their account and providing them with all necessary information to help them meet their own regulatory reporting obligations. No personal information of the user of the Consors Intelligence site is published without the user's knowledge, exchanged, transferred, assigned, or sold in any form to third parties. Only the assumption of the acquisition of Consors Intelligence and its rights would allow for the transmission of said information to the potential buyer, who would in turn be bound by the same obligation to maintain and modify data concerning the user of the Consors Intelligence site.

Security

To ensure the security and confidentiality of Personal Data and Health Personal Data, Consors Intelligence uses networks protected by standard devices such as firewalls, pseudonymisation, encryption, and passwords. When processing Personal Data, Consors Intelligence takes all reasonable measures to protect it against loss, misuse, unauthorized access, disclosure, alteration, or destruction.

Hyperlinks "cookies" and internet tags

The Consors Intelligence site contains a number of hyperlinks to other sites, set up with the permission of Consors Intelligence. However, Consors Intelligence does not have the ability to verify the content of the sites visited and will therefore assume no responsibility in this regard. Unless you decide to disable cookies, you accept that the site may use them. You can disable these cookies at any time and free of charge using the disabling options provided and recalled to you below, knowing that this may reduce or prevent accessibility to all or part of the Services offered by the site.

"Cookies"

A "cookie" is a small piece of information sent to the User's browser and stored on the User's device (e.g., computer, smartphone), hereinafter referred to as "Cookies". This file includes information such as the User's domain name, the User's Internet service provider, the User's operating system, as well as the date and time of access. Cookies cannot damage the User's device in any way. Consors Intelligence may process the User's information regarding their visit to the Site, such as the pages viewed and the searches performed. This information allows Consors Intelligence to improve the content of the Site and the User's navigation. Cookies facilitate navigation and/or the provision of services offered by the Site, and the User can configure their browser to decide whether or not to accept them, so that Cookies are stored on the device or, conversely, rejected, either systematically or based on their issuer. If applicable, Consors Intelligence declines any responsibility for the consequences related to the degraded operation of the Site and the services possibly offered by Consors Intelligence, resulting from (i) the User's refusal of Cookies (ii) the inability of Consors Intelligence to store or consult the Cookies necessary for their operation due to the User's choice. For managing Cookies and the User's choices, the configuration of each browser differs. It is described in the help menu of the browser, which will indicate how the User can modify their preferences regarding Cookies. At any time, the User can choose to express and modify their preferences regarding Cookies. Consors Intelligence may also call upon external service providers to assist in collecting and processing the information described in this section. Lastly, by clicking on the icons dedicated to social networks Twitter, Facebook, LinkedIn, and Google Plus featured on the Site of Consors Intelligence or in its mobile application, and if the User has accepted the placing of cookies by continuing to navigate the Site or the mobile application of Consors Intelligence, Twitter, Facebook, LinkedIn, and Google Plus may also place cookies on your devices (computer, tablet, mobile phone). These types of cookies are only placed on your devices if you consent to it by continuing your navigation on the Site or the mobile application of Consors Intelligence. At any time, the User can revert their consent to Consors Intelligence placing this type of cookies.

Governing law and jurisdiction

Any disputes related to the use of the Consors Intelligence website are subject to French law. Except in cases where the law does not allow it, exclusive jurisdiction is assigned to the competent courts of Lorient.
